Launched in 1990, the EB-5 Immigrant Investor Program offers foreign investors and their families a direct route to U.S. permanent residency. By investing $800,000 (in high-unemployment/rural areas) or $1,050,000 (standard) in a U.S. business that creates 10+ jobs, applicants secure Green Cards for themselves, their spouse, and unmarried children under 21. No employer sponsorship required—just freedom to live, work, or study nationwide.
For foreign investors seeking U.S. immigration, the EB-5 program offers:
- Family Green Cards – Covers applicant, spouse, and unmarried children under 21.
- Citizenship Pathway – Eligible after 5 years of permanent residency.
- Full Mobility – Live, work, or study anywhere in the U.S.; unrestricted travel.
- Business Freedom – Launch enterprises without immigration barriers.
- No Language/Experience Hurdles – Unlike employment-based visas (EB-2/3).
- Fast-Track Option – Often quicker for applicants from backlogged countries.
TEA Projects: $800,000 minimum
(Targeted Employment Areas - rural/high-unemployment zones)
Non-TEA Projects: $1,050,000 minimum
For Applicants Outside the U.S.

For U.S.-Based Applicants
Research & Initiation (1-3 months)

I-526E Approval (~6 months for rural projects)
Adjustment of Status → Conditional Green Card (timing varies)
2-Year Conditional Residency → File I-829 for permanent status (90 days before expiration)
Key Notes:
Rural projects may expedite I-526E approval (~6 months).
U.S. filers gain interim work/travel flexibility via EAD/AP.
Introduced under the 2022 EB-5 Reform Act, Priority Processing accelerates I-526E approvals for:
Rural TEA Projects (towns <20k population, non-metro counties)
Current Avg. Approval: ~6 months (vs. undefined timelines for non-rural)
Key Details:
Exclusive to rural projects—standard processing applies elsewhere.
No post-RIA data yet on non-rural petition timelines.
Established by Congress in 1993, EB-5 Regional Centers are USCIS-approved entities that:
Pool investments for large-scale projects (commercial/real estate)
Use economic models to calculate job creation (indirect/direct jobs)
Offer passive investment options with vetted developers
Handle compliance with USCIS requirements
Key Benefit: Investors meet EB-5 job creation rules without managing day-to-day operations.
